Un guide indispensable qui analyse le cadre juridique de la profession d'intermédiaire en assurance. Les polices proposées par les compagnies d'assurances s'avèrent très nombreuses et visent à couvrir une multitude de risques. La conséquence de cette pléiade d'offres consiste toutefois en la difficulté de choisir celle qui correspond le mieux aux besoins des candidats-assurés. À cet égard, les canaux de distribution des polices revêtent une importance essentielle, en particulier en ce qui concerne le rôle des intermédiaires en assurances. Outre ce rôle de conseiller, les intermédiaires peuvent, en outre, intervenir en faveur des compagnies d'assurances pour certaines tâches très spécifiques. De telles relations nouées avec les candidats-assurés et les compagnies d'assurances attestent de la particularité de la profession. Le législateur l'a d'ailleurs reconnu en encadrant son exercice, par le truchement de la loi du 27 mars 1995. Toutefois, cette loi ne régit pas toute l'activité des intermédiaires et elle doit être complétée par de nombreuses autres réglementations. Face à la difficulté d'appréhender le cadre légal dans lequel les intermédiaires en assurances interviennent, le présent ouvrage propose une analyse complète et transversale de l'ensemble des problématiques liées à l'intermédiation en assurances. Il aborde ainsi tant le cadre légal encadrant la profession que les relations entre les différents acteurs du contrat, en ce compris les régimes de responsabilité. Enfin, les règles relatives à l'exercice transfrontalier des activités, ainsi que les principaux éléments de droit fiscal, y sont exposés. Intraregional financial activity in Central America has grown substantially in the past decade, contributing to efficiency and economic development. At the same time, the expansion of activities by regional conglomerates has increased the challenges to supervisory authorities of containing the risks of contagion. Prepared as part of the Central America Financial Sector Regional Project by an IMF and World Bank staff team, this book outlines trends in the region's financial sector integration, supervisory responses, development of the insurance sector, payment and securities settlement arrangements, and worker remittances. It addresses the many common policy challenges facing Central American countries--Costa Rica, El Salvador, Guatemala, Honduras, Nicaragua, and Panama--in financial sector reform.
